O presente artigo apresenta um relato de experiência das ações extensionistas promovidas no ano de 2021 pelo Núcleo de Estudos Afro-brasileiros e Indígenas (NEABI) do Campus Ibirama da Instituto Federal Catarinense. Devido ao contexto de pandemia de COVID-19, que perdurou durante quase todo o ano letivo de 2021, as atividades do Núcleo precisaram ser adaptadas para que ocorressem em ambientes virtuais. Apesar desta adequação forçada, que limitou em grande medida a diversidade das ações, foi possível identificar tanto o promissor potencial (...) do NEABI quanto os desafios a serem superados para que a temática étnico-racial seja definitivamente incluída nos espaços institucionais e passe a fazer parte do cotidiano da comunidade escolar. I take as my starting point the evident fact that people are capable of modifying their beliefs in response to reasons in the course of deliberation. This fact is sufficient to make notions such as responsibility, blameworthiness, and praiseworthiness applicable to people with regard to their beliefs. If a state is such, and one is such, that one is capable of determining it through one’s best evaluations of reasons in the course of deliberation, then even if it isn’t under one’s (...) voluntary control, it is attributable to one as something for which one is appropriately held accountable. There is thus conceptual space for the possibility of one’s conducting oneself poorly or well with regard to it, and accordingly for the application of praise or criticism. And there is room for an evaluation of whether one has conducted oneself responsibly or irresponsibly – that is, whether one has proceeded in a way that takes proper account of the considerations which one reasonably could have been expected to take account of, or not. The topic developed herein locates in the point where Spinozism and feminism cross over. Based on some aspects of Spinoza's thought as pointed out by Moira Gatens' reading, a lattice (...) of connections will be built based on the notion pairs: body and power, bodies and imageries, sexed bodies and political body, power and creation. This paper argues that formal models of coherence are useful for constructing a legal epistemology. Two main formal approaches to coherence are examined: coherence-based models of belief revision and the theory of coherence as constraint satisfaction. It is shown that these approaches shed light on central aspects of a coherentist legal epistemology, such as the concept of coherence, the dynamics of coherentist justification in law, and the mechanisms whereby coherence may be built in the course of legal decision-making.

This paper argues for a coherentist theory of the justification of evidentiary judgments in law, according to which a hypothesis about the events being litigated is justified if and only if it is such that an epistemically responsible fact-finder might have accepted it as justified by virtue of its coherence in like circumstances. It claims that this version of coherentism has the resources to address a main problem facing coherence theories of evidence and legal proof, namely, the problem of the (...) coherence bias. The paper then develops an aretaic approach to the standards of epistemic responsibility which govern legal fact-finding. It concludes by exploring some implications of the proposed account of the justification of evidentiary judgments in law for the epistemology of legal proof. (shrink)

Is it coherent to suppose that in order to hold a belief responsibly, one must recognize something else as a reason for it? This paper addresses this question by focusing on so-called "Inferential Internalist" principles, that is principles of the following form: in order for one to have positive epistemic status Ø in virtue of believing P on the basis of R, one must believe that R evidentially supports P, and one must have positive epistemic status Ø in relation to (...) that latter belief as well. While such principles and their close relatives figure centrally in a wide variety of recent epistemological discussions, there is confusion in the literature about what, precisely, Inferential Internalism commits one to and whether it is so much as coherent. This paper articulates a broader framework for understanding the notion of epistemic responsibility, motivates Inferential Internalism on the basis of considerations about the basing relation, epistemic responsibility, and parallels with practical deliberation, defends Inferential Internalism against charges of incoherence leveled by James Van Cleve and Paul Boghossian, and shows that contrary to a currently widespread view, Inferential Internalism is coherent even if foundationalism and the a priori are rejected. The paper closes with a preliminary argument for an affirmative answer to the initiating question about the requirements of epistemic responsibility. (shrink)

Modern-day heirs of the Cartesian revolution have been fascinated by the thought that one could utilize certain hypotheses – that one is dreaming, deceived by an evil demon, or a brain in a vat – to argue at one fell swoop that one does not know, is not justified in believing, or ought not believe most if not all of what one currently believes about the world. A good part of the interest and mystique of these discussions arises from the (...) contention that the seeds of such arguments lie in our ordinary epistemic practices, so that external world skepticism can arise “from within”. But is this contention correct? I doubt it. Taking skepticism seriously requires that we address this question head on. To do so, I will approach skeptical arguments from a certain vantage point. I will try to stand, as far as possible, with both feet squarely in ordinary life. I will start out with all of our ordinary commitments about what is the case, about what we know or have reason to believe, about when someone knows, is justified, or has good reason to believe something, and about how one should proceed in deciding what to believe. My question, then, will be this. From within that vantage point can I somehow be moved in a reasonable way to accept the conclusion that I know far less about the world around me than I thought, or that epistemically speaking, I really ought not believe much of what I have believed about the world around me? In order for such movement to take place, I will have to find reason from within my ordinary standpoint to discount or reject much of what I ordinarily accept. A sizeable body of literature suggests that informal methods of dispute resolution — and, in particular, conciliation — flourish only in societies marked by extensive social hierarchy. Given this literature, it is quite surprising to discover that in the mid-nineteenth century, the United States embarked on an extensive debate regarding whether to adopt "conciliation courts," whose primary function was to reconcile the disputants by persuading them to embrace an equitable compromise. First created by the French Revolutionaries in 1790, conciliation courts (...) were widely established throughout continental Europe. Observing this development, leading American lawyers and politicians pondered seriously whether the United states ought to follow suit. Debate over whether to embrace such institutions occurred at the very highest of levels, and a series of states enacted constitutional provisions authorizing their legislatures to create conciliation courts. Ultimately, however, despite the widespread interest in such institutions, these were never established — except in the notable case of the Freedmen’s Bureau courts of the Reconstruction South. This Article explores this largely forgotten episode in American legal history. It examines why a nation that was radically egalitarian by standards of the time would seriously consider embracing an institution that we tend more commonly to associate with inegalitarian, strongly hierarchical societies — and why, after coming so close to adopting conciliation courts, it ultimately failed to do so. In the process, by situating the debate over conciliation courts in a broader social and legal context, the Article also excavates the origins of the modern, quintessentially American commitment to the virtues of formal, adversarial process. The forensic speechs are excellent source for the knowledge of Athenian law. The laws were used in the speeches to make them more persuasive. The Demosthenes’s speech Against Meidias is an example of the persuasive use of the law. The orator uses the laws to guarantee a legal base for the process and to characterize he and his enemy as good and bad citizens, respectively. The text will analyse the different uses of law made by Demosthenes in the referred speech.

Durante las décadas de los años 80s y 90s tuvieron lugar tres acontecimientos internacionales que marcarían la historia política, social y económica de principios de siglo XXI: la Caída del Muro de Berlín y la Perestroika; la Cumbre Ambiental en Rio de Janeiro y la Unión Europea. Acontecimientos históricos que profundizaron nuevas formas de administración pública en el seno de las naciones desarrolladas y en vías de desarrollo. Sucesos internacionales que fueron y son respuesta a las demandas de ciudadanos por (...) gobiernos más responsables con la gestión de sus necesidades de participación en: decisiones políticas, preservación del medio ambiente y seguridad económica. Pero, ¿de qué manera estos tres acontecimientos alteraron el orden económico, político y social en Colombia, y cómo esas nuevas tendencias de gestión pública han sido incorporadas en el municipio de Sabaneta-Antioquia? Visibilizar dichos cambios de gobernanza desde finales de los años 80s y 90s en Colombia capaces de explicar el buen desempeño alcanzado por el municipio de Sabaneta durante el periodo 2003-2013, es el objeto del presente ensayo de investigación. The Exceptionality of Solidarity In times of crisis, we witness exceptional expressions of solidarity. Why does solidarity spring in times of crisis when it wanes in normal times? An inquiry into what may explain the differences between the expression of solidarity in crisis vs. normalcy provides, as I will argue in this article, important insights into the conditions and nature of solidarity. Solidarity requires, I will contend, an egalitarian ethos and state action within and beyond the state. It is neither (...) a momentary political ideal, nor an exclusionary one, which depends for its sustainment on formal, legal, structures. Transient, sectarian, and informal conceptions of solidarity unduly curtail the demands of solidarity by restricting its reach to times of crisis, to in-group recipients, and to the social rather than the legal sphere. The article concludes by discussing some aspects of the dynamics of solidarity and its inherent risks that the analysis of the exceptionality of solidarity helps bring into focus. (shrink)

Este trabajo estudia algunas colecciones de documentos notariales árabes que se han conservado en Granada, desde el punto de vista de la mentalidad de archivo. Está especialmente enfocado al análisis de cómo y por qué sobrevivieron estos documentos y quién pudo pensar que se trataba de un material que merecía ser preservado. Este estudio contribuye a conocer mejor el comportamiento de los habitantes de Granada hacia los documentos árabes.

It is becoming increasingly clear that repetitive DNA is of biological significance as well as experimental importance. Here we review the information available about one type of repetitive DNA, the trinucleotide repeat (CAC)n, and briefly compare it with other trinucleotide repeats. Although much work has been done in analysing DNA fingerprinting patterns produced using the synthetic oligonucleotide (CAC)5 as a probe, there is relatively little information about individual (CAC)n‐containing sequences and their abundance, organisation and distribution in mammalian DNA. From the (...) data that is available, it is clear that there are at least two areas that should repay further study: (1) the organisation and generation of long sequences that contain (CAC)n motifs as part of a larger repeating unit (minisatellites) and (2) the distribution of small (CAC)n sequences (microsatellites), in particular their relationship to genes. This examination of a fundamental but often neglected aspect of the intellectual history of early modern Europe brings together philosophers, historians and political theorists from Great Britain, Canada, the United States, Australia, France and Germany. Despite the diversity of disciplines and national traditions represented, the individual contributions show a remarkable convergence around three themes: changes in the modes of moral education in early modern Europe, the emergence of new relations between conscience and law (particularly the law of the state), and (...) the shared continuities and discontinuities of both Roman Catholic and Protestant moral culture in relation to their medieval past. Studies have shown that students may feel emotional discomfort when they are asked to identify ethical problems which they have encountered during their training. Teachers in medical ethics, however, more often focus on the cognitive and rational ethical aspects and not much on students’ emotions. The purpose of this qualitative study was to explore students’ feelings and emotions when dealing with ethical problems during their clinical training and explore differences between two countries: Indonesia and the Netherlands. We observed a total (...) of eighteen ethics group discussions and interviewed fifteen medical students at two medical schools. Data were interpreted and analyzed using content analysis. We categorized students’ negative emotions based on their objects of reflection and came up with three categories: emotions concerning their own performance, emotions when witnessing unethical behaviors, and emotions related to barriers and limitations of their working environment. Our study suggests that addressing emotional responses in a culturally sensitive way is important to develop students’ self-awareness. Teachers should be able to guide students to reflect on and be critical of their own thoughts and emotions, to understand their own moral values, especially when confronted with other individuals. Johannes Kepler dedicated much of his work to discover a law for the refraction of light. Unfortunately, he formulated an incorrect law. Nevertheless, it was useful for anticipating the behavior of light in some specific conditions. Some believe that Kepler did not have the elements to formulate the law that was later accepted by the scientific community, that is, the Snell–Descartes law. However, in this paper, we propose a model that agrees with Kepler’s heuristics and that is also successful in (...) anticipating the behavior of light when it passes through a surface that separates two media with different optical densities. This model adopts strategies that were recommended by Kepler in two types of analogies. The obstacles that led to the failure of the two types of analogies are presented in the article, and we argue that the model proposed here could overcome these specific obstacles. Finally, we show how the proposed model could be articulated with Kepler’s metaphysics of light. (shrink)

We commonly speak of people as being ‘‘justified’’ or ‘‘unjustified’’ in believing as they do. These terms describe a person’s epistemic condition. To be justified in believing as one does is to have a positive epistemic status in virtue of holding one’s belief in a way which fully satisfies the relevant epistemic requirements or norms. This requires something more (or other) than simply believing a proposition whose truth is well-supported by evidence, even by evidence which one possesses oneself, since one (...) could entirely miss the relevance of this evidence and hold the belief as a result of wishful thinking or for some other bad reason. My topic in this paper is the notion of being justified which precludes beliefs flawed in this way. I will take the notion of something’s telling in favor of the truth of a proposition—that is, the notion of evidential support—for granted. (shrink)

Tom Kelly argues that instrumentalist aeeounts of epistemie rationality fail beeause what a person has reason to believe does not depend upon the eontent of his or her goals. However, his argument fails to distinguish questions about what the evidence supports from questions about what a person ought to believe. Once these are distinguished, the instrumentalist ean avoid Kelly’s objeetions. The paperconcludes by sketehing what I take to be the most defensible version of the instrumentalist view.

A pergunta pelo ser do homem é a origem da antropologia tanto filosófica quanto pedagógica. Neste horizonte, pode-se resumir a resposta à pergunta dizendo: o ser humano não só é efeito do diálogo, mas humaniza e se humaniza por meio do diálogo. Quando se planeja ambientes orientados a desenvolver as potências anímicas do diálogo em todos, e em cada um dos participantes da cena pedagógica, igualmente se está tanto em meio a uma antropologia pedagógica quanto a uma didática antropológica. Esta (...) foi a tradição que Christoph Wulf, na segunda metade do século XX e no começo do século XXI, sistematizou. Dentro desta corrente de pensamento se enquadra a investigação intitulada Diálogo: condição de formação. Assim, pode-se afirmar que este projeto se baseia na tradição alemã que põe a Bildung no centro, como uma categoria que, ao mesmo tempo, tem uma fundamentação filosófica e alguns efeitos tanto na concepção quanto na ação pedagógica. Charles Peirce provided a few, but interesting we believe, remarks about metaphor. Aristotle on the other hand developed a theory of metaphor that, to this day has been, and still is, influential (even though his theory, especially within recent years, also has been heavily criticized, e.g., by Lakoff, George & Mark Johnson. 1980. Metaphors we live by. Chicago: Chicago University Press). Factor, Lance R. 1996. Peirce’s definition of metaphor and its consequences. In Vincent Colapietro & Thomas Olshewsky (eds.), Peirce’s doctrine (...) of signs: Theory, applications, and connections, 229–235. Berlin/new York: Mouton De Gruyter, as one of very few scholars, makes a comparison between Peirce and Aristotle. Factor claims that Peirce’s definition of metaphor and its consequences undermine and overturn Aristotle’s theory. We do not believe that Factor is right; and this is due to Factor’s misinterpretation of key elements within Aristotle’s theory. We rather believe that Peirce and Aristotle, in fact, have central ideas in common concerning metaphor; perhaps, in particular, when it comes to the function of metaphor. Hence, both see, for example, metaphor as a cognitive mechanism. The article tries to develop this argument. (shrink)

Este artículo presenta una reflexión respecto a la dimensión política de quienes ejercemos la labor bibliotecaria o bibliotecológica, enmarcada en la educación inclusiva del Sur Global, donde se parte del reconocimiento de la labor bibliotecaria y bibliotecológica asociada, generalmente, con un conocimiento práctico de las cosas o techné, debido a las condiciones históricas en que la disciplina científica se consolidó como tal. Empero, cada vez más se hace necesario que esta labor se proyecte de manera consciente y decidida hacia el (...) afianzamiento de la bibliotecología como campo de conocimiento necesario y útil para el logro de los principios sociales de la democracia, la justicia social y los derechos humanos; reconociendo, así, su dimensión política. Inicialmente se presenta una introducción histórica a la bibliotecología como ciencia. Después, se expone el significado sobre ser bibliotecario en Latinoamérica a la luz de las funciones sociales de la biblioteca y la bibliotecología. A continuación, se interpela la necesidad de que quien ejerce la labor bibliotecaria debe ser un sujeto político, incluso a pesar de sí mismo. Como preámbulo al cierre se presentan, a través de casos específicos y manifestaciones de acción social comunitaria, ejemplos de la dimensión política del bibliotecario. Finalmente, se cierra con una serie de propuestas y desafíos para trabajar en el fortalecimiento de una práctica política en la labor bibliotecaria o bibliotecológica en el Sur Global. (shrink)

El pluralismo cultural y la diversidad social atraviesan diferentes contextos sociales en el mundo contemporaneo, ejerciendo diferentes impactos sobre las instituciones oficiales. En el contexto de los servicios de salud de una ciudad cosmopolita como Montreal, la realización de nuevos proyectos de investigación y de intervención se hace necesaria, con el fin de evaluar la manera como los diversos grupos poblacionales entran en relación con dichos servicios. A nivel investigativo, se hace indispensable la creación de colaboraciones interdisciplinarias con las cuales (...) poder examinar las situaciones clínicas, a la luz de los diferentes elementos que la componen: sociales, culturales y étnicos. En este artículo, expongo algunas reflexiones que se derivan de una investigación interdiscip-linaria entre antropólogos y médicos, cuyo tema central giro en torno de los desórdenes funcionales del intestino dentro de la población infantil. Este trabajo en antropología médica permitió documentar y analizar los discursos de las familias y de los niños alrededor de la percepción de dicho problema de salud, así como de las prácticas y soluciones que estos ponen en marcha y con las cuales buscan aliviar el dolor y lograr un estado de bienestar. Las reflexiones que comparto en este artículo tienen como centro de interés los principales referentes teóricos y metodológicos utilizados desde la disciplina antropológica, los cuales seran ilustrados con la ayuda de algunos extractos de entrevistas realizadas. Mas allá de simplemente enumerar los resultados de la investigación, muestro un ejemplo de colabora-ción fructífera entre la antropología y la pediatría, la cual abre perspectivas de investigación y de aplicación futuras en lo que atañe a las relaciones entre las familias, las comunidades y los servicios institucionales. In this paper I shall address the connections between Deleuze and Guattari’s philosophy and Caribbean thought. However, I will only focus on Antonio Benítez Rojo’s essay The Repeating Island, since I have found in it the presence—or expression—of some key deleuzian and deleuzo-guattarian concepts. I will use the deleuzian concept of repetition to defend this stance, as well as to argue that one may find some of the most interesting readings of Deleuze’s texts in the work of Caribbean authors such (...) as Benítez Rojo, not only in spite of their relative understanding and lack of exegetical rigour, but rather thanks to the fact that this is, in no case, their main intention. The angle I have chosen does not intend to point out consistencies or inconsistencies in Benítez Rojo’s “appropriations” or “rewritings” of Deleuze and Guattari, for this would only keep us within the logic of the copy versus the original. Instead, this reading tries to destabilize the boundaries between philosophy and literature as well as between French and Caribbean thought. The undoing of these types of distinction intends to produce a new theatre of thought, a theatre of repetition, not of representation, in order to set up the scene for a contrapunteo between two images of thought: one deleuzian, the other Caribbean. Thus, we embark upon this journey hoping to have an encounter that promises yet another becoming to Deleuze’s philosophy. The angle I have chosen does not intend to point out consistencies or inconsistencies in Benitez Rojo’s “appropriations” or “re-writings” of Deleuze-Guattari, for this would only keep us within the logic of the copy versus the original. Resumo: A ausência de planificação educacional para as escolas rurais, a despeito de algumas iniciativas públicas e privadas em décadas anteriores, não possibilitou um processo que fortalecesse e garantisse o desenvolvimento sociocultural das populações campesinas. Excetuando o Ruralismo Pedagógico da década de 30, que pretendia uma educação rural desconexada da realidade, e as parcas manifestações do Ministério da Educação nos anos 40/50 sobre a escolaridade rural, as primeiras intenções e/ou propostas para uma política educacional direcionada aos centros não-urbanos, somente aconteceram (...) a partir dos Planos Setoriais de Educação na década 70/80. Com base nas questões econômicas internas, o I e II Plano Nacional de Desenvolvimento (PND) têm, na educação como um todo, apenas um referencial para análise do subdesenvolvimento em que se encontrava o país. Dada a ênfase urbano-industrial do ideário da época, a educação rural é incorporada aos programas de desenvolvimento global (assim como a educação urbana), não se levando em consideração, desse modo, suas necessidades e realidades próprias. Resumo Este estudo desenvolve uma análise do desenvolvimento do papel dos sonhos e das visões na literatura bíblica. Busca apontar as diferentes abordagens do tema segundo os diversos redatores bíblicos e seus os momentos históricos específicos. Pondo em relevo, principalmente, o papel da literatura profética e das ações do Estado como introdutores de uma relativização do caráter dos sonhos como elementos justificadores teológicos. Discutimos, a seguir, a recepção desse material pelos rabinos, autores do Talmude. Apontamos que a discussão rabínica sobre (...) o tema segue a perspectiva literária mais ampla, mas aprofunda as preocupações gerais com o império das visões sobre o olhar religioso. Provavelmente por conta das trágicas experiências políticas derivadas do pensamento apocalíptico e sua inclinação geral às revelações oníricas. De uma forma geral os rabinos do Talmude procuram resolver o problema do papel instabilizador dos sonhos através do simultâneo reconhecimento de sua importância e redução ou delimitação de sua relevância enquanto experiência de revelação religiosa. Palavras-chave: Judaísmo; Teologia judaica; Talmude; Sonhos na Bíblia; Sonhos no Talmude.This paper focuses on the development of the role of dreams and visions in biblical literature, presenting different approaches to the theme according to the various biblical authors and their specific historical moments. It emphasizes the influence of prophetic literature and State actions in the relativization of the nature of dreams as theological justifications. It then analyzes the reception of this material by the rabbis who wrote the Talmud. We sustain that the rabbis follow the wider literary mainstream but express a general concern for the empire of visions within the religious scope. That is maybe due to tragic political experiences derived from their apocalyptic thought and to their natural tendency to oniric revelation. We conclude that the Talmud rabbis tried to solve the problem of the destabilizing role of dreams by simultaneously recognizing their importance and reducing or limiting their relevance as a religious revelation experience.
